Bayshore Building Ban Backed Off

BAYSHORE - The city will not call for a moratorium on development on Bayshore Boulevard, at least for now.

City Attorney David Smith told the city council on Thursday that it is premature to look at halting development on the scenic road until further work is done to determine what the city wants to restrict.

The council told Smith to look at the potential of a moratorium as part of creating more detailed zoning restrictions on Bayshore.

The Bayshore Overlay District Committee asked for the restrictions - including limiting building heights to 120 feet and a minimum 40-foot setback - in the wake of multiple condominium tower rezoning proposals.

Instead of creating an overlay district, the city plans to amend the comprehensive plan to include the Bayshore guidelines as well as some for other neighborhoods.

Smith said city staff needs to begin work before the council seeks an injunction on development.

"It is appropriate to look at it farther down the line when you have identified what you want to abate," Smith said. "We want to hold off until we do a little more analysis."

The council will next discuss a possible moratorium Sept. 7.
