Judge says Mattamy Homes can proceed with development in South Hillsborough

Mattamy Homes may proceed with plans to build 205 single-family homes and a commercial village in Riverview, a Hillsborough County circuit judge has ruled.

Hillsborough County circuit Judge Jennifer Gabbard on Monday issued an order quashing a rezoning denial that Hillsborough County commissioners handed down in April 2021.

A Hillsborough County spokeswoman was not immediately available for comment Monday.

A contingent of landowners was under contract to sell 102.6 acres southwest of Boyette Road and west of Balm Boyette Road in Riverview to Canada-based Mattamy when Hillsborough County commissioners denied their rezoning request.

Mattamy and the landowners filed a legal petition asking a court to review the county's action. It also sought damages in excess of $30,000, exclusive of attorneys' fees, interests and costs, for the two-year delay associated with the rezoning denial. Gabbard denied the damages request.

"We are pleased the court recognized the denial of the rezoning was unlawful," said Scott McLaren, a partner at Hill Ward Henderson in Tampa who represents Mattamy. "We are weighing our options concerning the adverse decision on the damages claim."
