St. Pete Beach development plan in judge's hands

ST. PETE BEACH - The years-long dispute over how the city should be redeveloped entered a new phase last week in a trial over the legality of a 2008 voter referendum.

At issue is whether the language appearing on the ballot sufficiently described the purpose and intent of ballot questions amending the city's Comprehensive Plan.

If not, the city would most likely be forced to hold a new referendum on the voter-approved plan.

The amendments originally were proposed by one group, Save Our Little Village, which favors more intense development, particularly in hotel districts.

The lawsuit was filed by William Pyle, a supporter and member of a rival group, Citizens for Responsible Growth, which favors less dense development with stricter limits on building heights.

The one-day trial ended with no clear result.

Attorneys for the city, SOLV and Pyle have 40 days to file final briefs and responses before Circuit Court Judge David Demers begins to consider his ruling.

Whichever side loses the case is expected to appeal.
