Lender files suit to foreclose on Pasadena Yacht and Country Club golf course, marina

GULFPORT - A lender for Colorado investors who own Pasadena Yacht and Country Club is seeking to foreclose on the golf course and marina, according to a suit filed in Pinellas-Pasco Circuit Court.

The case, filed in January, claims Colorado limited liability companies that owe millions on the properties purchased in 2004 stopped making loan payments in November.

Joe Meyer, general manager for Pasadena Yacht and Country Club, said Monday he had good news to share, but didn't return phone messages Tuesday.

The suit's defendants are CFC Pasadena Golf LLC, CFC Pasadena Yacht LLC and CFC Property Holdings LLC.

Texas lender Americo Financial Life and Annuity Insurance Co., which purchased the notes in 2007, asks for foreclosure on two mortgages and damages for any difference between the sale price of the properties and the amount owed. It also wants a receiver to be named.

As of Jan. 9, the suit said, $2.8 million was owed on the golf course, plus $56,000 in interest, in addition to default interest and fees. On the marina, the suit says $1.8 million is owed, along with $42,000 in interest, plus default interest and fees.

With missed payments in November, the full balances came due.

A Tampa attorney for Holland & Knight who helped file the lawsuit says it's now being handled by Guy Motzer of Squire Sanders in West Palm Beach, who didn't return e-mail or phone messages.

Poul Hornsleth of RW Caldwell Inc. has lived in the Skimmer Point area of Pasadena Yacht and Country Club since 1981. His in-laws, the Caldwells, had been involved with the country club for decades. He drops by the clubhouse a few times a week. He hadn't heard of the lawsuit but he said he wasn't concerned.

"It's a magnificent piece of property that has value," he said.
